Just a short note to let all of you know that we will be handling future posts, and information on upcoming Cyber Conferences beginning June 1, 2022. Ross & Keppler will no longer be handling the posting of such information. With the approach of the summer months, the speakers will be on summer hiatus. As soon as we verify the dates of hiatus and dates regarding their return, it will be posted promptly.
Complete transcripts & minutes from April's conference will be re-posted shortly. We will be utilizing a different format which will be easier to follow. Summary: {07:02-PM}-Speaker Pat R. opened the meeting by introducing himself. Gave a brief history about where he grew up, his educational background, and his current job/ profession. A brief discussion about his wife and two children {college students}, where he currently resides.
{Trs-032}-Gave a detailed summary about his Cyberbullying incident in 2016: how the incident changed his life; the name of his Cyber Stalker, and some background about his stalker. When he decided to take action, the skilled and very experienced attorney he chose. The evidence collection method, which included executing a Subpoena and conducting background check data. Drafting legal briefs regarding the case.
{Trs-034}- Gave detail as to why his Cyber Stalker-Mr. Darren Ambler of Cherry Hill, New Jersey began his 'revenge stalking' against speaker Pat R. The daily drama which the stalking caused and an eventual resolution to the Cyber Stalking incident.
Case Facts: {Trm-056}- Was stalked by Mr. Darren Ambler for 3 and 1/2 months beginning April 19, 2016. Pointed out that Cyberbully Darren Ambler was not 'discreet' while cyberstalking the victim. Furthermore, Darren Ambler continually cyber stalked with intent to harm from his Lap-Top computer located at his then residence. The harassment continued on a daily basis. It is unclear if Mr. Ambler was aware at the time that he was in fact committing a 'Felony' crime within the state of New Jersey.
Interesting Point: {Ts-6613}- The victim was aware he was being harassed and stalked online. He also was certain who the culprit was: Speaker stated he had no enemies at the time therefore, it was quite easy to determine that Mr. Darren Ambler was responsible. Within about 40 days it was confirmed {through evidentiary proofs} that Darren Ambler committed the act of Cyber Stalking--Harassment and Invasion of Privacy upon his intended victim.
Case Law/ Ramifications: Online Stalking constitutes a Felony crime. Severe punishment is enforced for first-time offenders. The courts have no tolerance for anyone guilty of computer crime. This particular case was handled on a Municipal Court level. However, a case such as this can be filed and heard within a County Jurisdiction. If a jury trial was/is granted, then the case may take up to 12 months to conclude.
Right of Victim/ Attorney Interest: Pat R discussed how his attorney assured him they had an absolute winnable case. An abundance of direct and compelling evidence was obtained. Therefore had the case been pursued-Mr. Ambler would have likely received a 6-month jail term within a municipal jail setting. A furthermore-A fine of not more than $10,000 would have been levied against Mr. Ambler by the courts. Possibly a three-month probationary period would have followed after release.
Permanent Filings/Records: Once convicted of Cyber Stalking/Harassment the defendant will have a Felony on his/ her permanent file. Felony convictions can have serious ramifications for many years.
Personal note {attorney--client resolve}-Victim {P.R} expressed he wanted Mr. Ambler punished for his deliberate actions. Attorney shared the opinion that Mr. Ambler was troubled and needed to be punished. However, the attorney stated if we did go to trial to could take 12 or more months. In addition, additional attorney fees and court costs could be excessive. Finally, by keeping the case against Mr. Ambler going the attorney pointed out that it would produce great stress and aggravation for the victim. Speaker {P.R} stated that he had a family {wife and kids} that depend upon him. He did not want to further stress his family or himself by dealing with someone as 'unimportant' and 'mentally' screwed up as Darren Ambler. That Mr. Ambler isn't worth being stressed over.
Also, stated he had a responsible and demanding career and did want a lengthy trial to interfere with his productivity and daily work schedule.
Decision: Due to the facts stated above. Although Mr. Ambler deserved punishment. Victim {Pat R}-agreed to drop/ settle a case against Darren Ambler. His attorney prepared a document stating the reason for the decision.
Stipulations/ Notations: Attorney prepared a document with specific clause which stated: AFTER SEVERAL DISCUSSIONS WITH MY CLIENT REGARDING CASE AGAINST DARREN S. AMBLER. THE CASE WITHOUT A DOUBT IS A WINNABLE ONE. HOWEVER, MY CLIENT AGREED IT IS IN HIS BEST INTEREST TO SETTLE THIS MATTER AND FILED THIS MATTER AS A CLOSED AND RESOLVED MATTER.
HOWEVER {CLAUSE #1658-C}--IN THE FUTURE IF MR DARREN AMBLER, RESUMES ANY FORM OF HARASSMENT AND/OR STALKING BEHAVIOR TOWARD MY CLIENT: WHICH INCLUDES ONLINE STALKING--HARASSMENT--SLANDER OR BY THE SPREADING OF MALICIOUS-UNTRUE GOSSIP WITH INTENT TO HARM MY CLIENT-A NEW CASE WILL BE FILED WITH THE COURTS AND JURY TRIAL WILL BE DEMANDED. I/WE WILL SEEK PROSECUTION AND DEMAND PUNISHMENT IS RECEIVED FOR THE OFFENSE COMMITTED MAXIMUM
ALLOWABLE BY LAW.
Explanation of clause: If Mr. Ambler ever harasses or stalks his client in the future. The attorney will ask for a jury trial and he will ask a judge to impose the maximum punishment allowable for such an offense. Basically, Mr. Ambler needs to leave the victim alone. Don't make any remarks or statements about the victim verbally or otherwise. Mr. Ambler should exercise caution in the future if he uses online Internet forums.
**.Speaker #2 takes over: {Tr-286-D}:
Speaker {Jeff G.}-Also gave a detailed summary of his Cyber Stalking ordeal. It seems Jeff's stalker had similar traits in comparison with Mr. Ambler. However, this stalker was confrontational in an overly aggressive manner whereby Darren Ambler was not In this case, the online bully threatened Jeff's teenage daughter. This became a matter of extreme concern and worry for jeff. The Police and attorneys are a great help. However, they can not guard you and your family members 24/7. Township Police did patrol Jeff's neighborhood after dark. Again, they can't be there all the time. Jeff stated some nights were brutal. Some nights Jeff and his wife Sharon received little sleep. Every little noise they heard at night spooked them.
it affected his physical and mental well-being. Keep in mind-action can't be taken until sufficient proof is obtained. It is costly for the average person to pursue a cyberbullying case.
Eventually, the stalker was taken to court. The result was positive. However, the toll it took on his well-being was terrible Jeff said he found out firsthand how a cyberbully can cause havoc for a family. Jeff learned that the Internet can have a dark and sinister side when it's misused by the wrong people.
